Subrogation in Italy: to go or not to go?

An insurance company (KIAP Law Firm's client) and an insured entered into a general cargo insurance contract. During loading in the port of Ortona, Italy, the packaging of the cargo caught fire as a result of welding operations in the hold. During an inspection in the port of Azov, surveyors discovered damage to the equipment delivered. In the insured’s view, the damage was caused by defective work performed by a contractor (an Italian company) engaged for the loading and securing of the cargo. The insured sent the contractor a claim for compensation for the loss caused by the damage to the equipment in the port of Ortona.

KIAP Law Firm's lawyers assessed the prospects of recovering the loss by way of subrogation and the reasonableness of bringing a claim against the contractor including from a cost-benefit perspective.
